2 Acceptable
use policy
The following terms govern the purchase and use
of the Services by You. You agree to comply with the terms and spirit of the Agreement.
2.1 You will not use the Services for spamming. Spamming includes,
but is not limited to:
- 2.1.1
The
bulk sending of unsolicited messages, or the sending
of unsolicited e-mail's which provoke complaints from
recipients,
- 2.1.2 The sending of junk mail,
- 2.1.3 The use of distribution lists that include people who have
not given specific permission to be included in such distribution process,
- 2.1.4 Posting articles containing binary encoded data to a non-binary newsgroups,
- 2.1.5 Excessive and repeated posting off-topic messages to
newsgroups,
- 2.1.6 Excessive and repeated cross-posting,
- 2.1.7 E-mail harassment of another Internet user, including but not
limited to, transmitting any threatening, libellous or obscene material, or material of any nature which could be deemed to
be offensive
- 2.1.8
The e-mailing of age inappropriate communications or content to anyone
under the age of 18. Where the World Meets has in place a spam monitoring
and control system to reduce spam sent to and from users, Where the
World Meets shall make reasonable attempts to respond to complaints
made by users regarding the receipt of spam or other harassing e-mail
or, in the case of a user under the age of 18, complaints from such
user or from such user's parent or guardian regarding the receipt of
spam, other harassing e-mail, or e-mail containing any age inappropriate
communications or content.
2.2 You will not use the Services in
a manner which violates any city, local, state, national
or international law or regulation, or which fails to
comply with accepted Internet protocol. You will not
attempt to interfere in any way with Where the World
Meets networks or network security, or attempt to use
the Services to gain unauthorised access to any other
computer system.
2.3 You will at all times provide Where
the World Meets with accurate information. You will
immediately notify Where the World Meets of any security
breach in or unauthorised use of your account. You will
not interfere in any way with another user's use of,
the Services. You will not resell, rent, lease, grant
a security interest in, or make commercial use of the
Services without the express written consent of Where
the World Meets.
2.4 You agree not to transfer your e-mail address for gain or otherwise. Transfer of such e-mail address
will result in immediate termination of your membership and your contract.
2.5 You agree not to assign, transfer, or authorise any other person to use, your membership.
If you try to do so, Where the World Meets has the right to terminate your membership.
3 Price and payment
3.1 Prices are inclusive of any applicable VAT or sales tax. All banking charges on payments to Where the World Meets shall be borne by Where the World Meets
3.2 Any details given in relation to exchange rates are approximate only and may vary from time to time. Where the World Meets
will bear their own costs of currency conversion.
3.3 You will pay all sums due to Where the World Meets under this Agreement by the means specified without any set-off, deduction,
counterclaim, and/or any other withholding of monies.
3.4 Either party may terminate this Agreement at any time, for any reason. Termination of the agreement by either party
will be effective upon that party sending written notice to the other party of their intentions. To terminate the Agreement You must complete the form on Our termination page. Where the World Meets reserves the right to check the validity of any
request to terminate membership.
3.5 All monies paid by You to Us are non-refundable and cancellation and/or termination of this Agreement by You or Us at any time
for any reason will not entitle You to a refund of monies paid.
4 Privacy policy - Review our privacy policy. Note that the privacy policy is sacrosanct to Where the World Meets, even where information is provided by a user who is not a member or is a person whose rights are restricted by this agreement.
4.1 You agree that You will keep confidential and not use, except for purposes contemplated by this agreement, any information relating to the Services which may be disclosed to you or which you may learn, except where such information is public knowledge or it is required to be disclosed by law.
4.2 Where the World Meets will use all reasonable endeavours to comply with the privacy policy.
4.3 Where the World Meets will not record or store (except for instant onward transmission) any credit card number or reference.
5 Intellectual
property rights
Title, ownership rights, and intellectual property rights in all content and material that is part of, contained in, or accessed through the Where the World Meets Site or Services, and provided by either Where the World Meets or any other content provider shall remain the sole property of Where the World Meets and / or any other content provider. You acknowledge and agree that certain college, university, team, celebrity or business names contained within Where the World Meets e-mail addresses may represent protected trademarks and service marks. Such content and materials are protected by the copyrights, trademark, service mark and patent laws and treaties of all countries.
6 Indemnity
You agree to indemnify and hold Where the World Meets and its Associates harmless from any claim or demand,
including reasonable lawyers' fees, made by any third party due to or arising out of your use of the Services,
the breach or violation of this Agreement by you, or the infringement by you, or by any other user of the Services
using your computer, of any intellectual property or other right of any person or entity, or as a result of any
threatening, libellous, obscene, harassing or offensive material contained in any of your communications.
7 Disclaimers
7.1 Where the
World Meets gives no warranty, express or implied, as to the truth of
any information given on the Site by any Associate or third party.
7.2 In addition to Your statutory rights, Where the World Meets warrants that all goods and services purchased through the Site shall be of satisfactory quality, and shall comply with any description of such product and service on the Site.
7.3 Much of
the material provided on the Site is Posted (and thereby published)
by Members. Where the World Meets is under no obligation to vet, check
or approve any such material. Where the World Meets disclaims all responsibility
for such material.
7.4 Where
the World Meets takes no responsibility for the wrongful use of any
information published on its web Site by any person.
7.5 These
disclaimers form an essential part of this agreement. If in any place, the jurisdiction does not allow any one or more such disclaimers, or automatically provides specific warranties, then this paragraph shall be binding on the parties, only to the extent minimally necessary to bring it within the laws of that jurisdiction and to prevent it from becoming void.
8 Limitation
of liability
Under no circumstances
and under no legal theory or proposition, whether in tort, contract or
other, shall Where the World Meets or its licensors be liable to you or
to any other person for any indirect, special, consequential or incidental
damage including (without limitation), damage resulting from the use of,
or the inability to use, the Services, the performance of the Services,
or damages for loss of goodwill, business profit, business stoppage, loss
of data or business information, computer damage or damages resulting
from unauthorised access to or changes made to your transmissions or data
or any and all other commercial damages or losses. The liability of Where
the World Meets shall always be limited to the amount you paid to Where
the World Meets for the Services. If in any place, the jurisdiction does
not allow such a disclaimer, or automatically provides specific warranties,
then this paragraph shall be binding on the parties, only to the extent
minimally necessary to bring it within the laws of that jurisdiction and
to prevent it from becoming voidable
9 Contractual
limitation
Where a service is provided by Where the World Meets without specific charge, then it is deemed to be provided free
of charge, and not to be associated with any other service for which a charge is made. Accordingly, there is no
contractual nor other obligation upon Where the World Meets in respect of any such free service.
10 Storage
of data
Where the World
Meets assumes no responsibility for the deletion or
failure to store, deliver or timely deliver messages.
Without limiting the foregoing sentence, Where the World
Meets may, from time to time and without notice, set
limit(s) on the number of messages a member may send,
store, or receive through the service, and Where the
World Meets retains the right to delete any e-mail's
above such limit(s) without any liability whatsoever,
and you hereby release Where the World Meets from any
such liability. Any notice provided by Where the World
Meets to you in connection with such limit(s) shall
not create any obligation to provide future notification
regarding any change(s) to such limit(s).
11 Infringement of intellectual property rights
You represent that the log in ID selected by you, when used alone or combined with a second or third level domain name, does not interfere with the rights of any third party and is has not been selected for any unlawful purpose. You acknowledge and agree that if such selection does interfere with the rights of any third party or is being selected for any unlawful purpose, Where the World Meets may immediately suspend the use of such Where the World Meets e-mail address, and You will indemnify and hold Where the World Meets harmless, in accordance with the Indemnification section above, for any claim or demand against Where the World Meets that arises out of such selection. You acknowledge and agree that neither Where the World Meets nor any of its licensors shall be liable to You in the event Where the World Meets is ordered or required, as a result of a court order or legal settlement, or contractual requirement with any Associates, to desist from using or permitting the use of a particular domain name as part of a Where the World Meets e-mail address. If as a result of such action, you lose an e-mail address, your sole remedy shall be the receipt
of a replacement Where the World Meets e-mail address.
12 Modification
Where the World Meets reserves the right to modify the Services as described in this agreement and on the Site, and to change
the terms and conditions of this agreement at any time, without notice. Continued use of the Where the World Meets Services
after such modifications shall be deemed an acceptance by you to be bound by the terms of the modified agreement.
13 Termination
13.1 Where the World Meets Services may be terminated for any reason, in whole or in part, effective immediately, by either Where the World Meets at any time without notice and without any liability whatsoever, and you hereby release Where the World Meets from any such liability. Upon termination, your right to use the Where the World Meets Services immediately ceases, and Where the World Meets is not obligated to forward any unread or unsent messages to you or any third party. Where the World Meets shall not be liable to you or any third party for termination of the Where the World Meets Service. In the event of any such termination by Where the World Meets, Where the World Meets will within seven days refund to you the balance of your subscription outstanding for any Service, pro rata with time not elapsed.
13.2
There shall be no reimbursement
or credit if the Where the World Meets Service is terminated due to your
violation of the terms of this agreement. Where the World Meets reserves
the right to terminate your e-mail address in the event that Where the
World Meets' rights to use certain domain names or e-mail addresses terminate
or expire.
13.3
Where the World Meets
retains the right, at Where the World Meets' sole discretion, to terminate
any and all parts of the Services provided to you, without refunding to
you any fees paid if it determines that You have failed to comply with
any of the terms of this agreement.
13.4 If
Where the World Meets determines that you have failed to comply with any of the terms of this agreement above, Where the World Meets shall, if and when it deems it appropriate, (1) facilitate criminal prosecution against you by referring your spamming activity to the appropriate legal authorities, and (2) bring a civil action against you, when you will be liable to Where the World Meets for any direct, indirect, special, incidental, or consequential damages incurred by Where the World Meets as a result of your spamming or other prohibited activity.
14 Severability
If any provision hereof shall at any time be held by any jurisdiction to be void, invalid or unenforceable, then it shall
be binding on the parties, only to the extent minimally necessary to bring it within the laws of that jurisdiction and to
prevent it from becoming voidable. Subject to that, each provision shall be construed as severable and shall not in any way
affect or render void, invalid or unenforceable any other provision of this Agreement, and this Agreement shall be carried
out as if such void, invalid or unenforceable provision were not part of this Agreement.
15 Action limit
You and Where the World Meets agree that any cause of action arising out of or related to this Service must commence within
one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred.
16 No waiver
No waiver on the part of Where the World Meets, in exercising any right, power or provision hereunder shall operate as a waiver of any other right or of that same right at a future time; nor shall any delay in exercise of any power or right be construed as a waiver.
17 Where the
World Meets successor and assign
This Agreement shall be binding upon and continue to the benefit of any Where the World Meets successor company or assign.
18 Headings
The headings in this Agreement are for convenience only and shall not affect the meaning or interpretation of this Agreement
or any provision thereof.
19 Entire agreement
This is the whole of the Agreement between Where the World Meets and you. It supercedes all prior agreement and understanding.
If there is any conflict between this Agreement and any other part of the Site, then this Agreement shall prevail. Unless
otherwise stated these terms and conditions will survive termination of your membership of Where the World Meets, or of any
service of Where the World Meets. For the avoidance of doubt this agreement does not govern the contractual relationship
between Where the World Meets and any business partner, advertiser, Affiliate or affiliate.
20 Amendment
to agreement
Where the World Meets reserves the right to amend any of these terms and conditions at any time. Notice of any such change,
amendment, or addition shall be sufficient if a reference to the fact that a change having been made is posted on the Site
for a period of at least seven days.
21 Governing law
This Agreement shall be governed by and construed in accordance with the laws of England.

"Where Singles Meet" services
22.1
These paragraphs apply
only to the services of "Where Singles Meet" ("WSM Services").
22.2 You now warrant that you are over the age of 18 years. If you are under the age of 18 years, you agree that you
will not visit nor attempt to use those parts of the Site operated as WSM Services.
22.3 Where the World Meets reserves the right to monitor and if Where the World Meets thinks necessary, to remove for any
reason any information, photographs and/or other material Posted by you.
22.4 Where the World Meets may refuse to register applications for membership and may terminate memberships at any time.
22.5 You acknowledge that any details Posted by you on WSM Services may be seen by all Members.
22.6 You alone are responsible for the accuracy of all information you give us. This includes all of your interactions
with other members.
22.7 Your details and profile will be displayed on WSM Services and you may view the published details and profiles of other Members. You will not be able to contact or interact with other Members until Where the World Meets has received payment.
22.8 You are solely responsible for your own interactions with other Members.
23 Members' obligations
- 23.1 You may not:
- 23.1.1 Post your contact details such as telephone number, address, e-mail address or URL in your Profile;
- 23.1.2 use the Service to promote another Site, service and / or business;
- 23.1.3
transmit and/or Post
and/or e-mail to another member any information, pictures and/or any other
material, which in the opinion of the Site administrator is sexually explicit,
racist, abusive, threatening or likely to cause offense to another member.
24
Where the World Meets
may in its absolute discretion remove published material at any time and
for any reason. The "editorial policy" of Where the World Meets
will be displayed from time to time on the web site, but Where the World
Meets reserves the right to amend such policy without notice.
"I have read and understood Where the World Meets' terms and conditions, and I agree to abide by them. If I am under
the age of 18 years, I confirm that I have brought the terms and conditions to the notice of my parent or guardian,
and that person has agreed that I may join."
